Poulomi Pavini Shukla, author of Weakest on Earth: Orphans of India, has been fighting for the rights and reservation of orphaned children. She was filed a public interest litigation in the Supreme Court of India in 2018, seeking judicial intervention in ensuring right to life, right to equality specifically for children who are orphans and all “children in need of care and protection.”

The PIL seeks reservation for orphan children- who are as deserving as any OBC or the third gender to whom the Supreme Court has recently extended its support.

“The same or more financial, educational and empowerment support be given to orphan children as what is given by the government to various categories of children who have parents,” says the petition.

  • Poulomi’s P.I.L. asking for more budget and support for orphans, on which the Supreme Court issued notice in 2018, the Union Government’s budget for orphans increased from Rs. 750 Crores in 2018-2019 to Rs. 1500 Crores in 2019-2020.
  • In fact, her PIL resulted in the National Commission for Backward Classes recommending orphans to be considered part of OBCs, along with several states and Union Territories extending education reservations and financial aid to orphans.

Prayers

The PIL primarily seeks the following relief:

  • ‘Reservation’ for ‘orphans’ – who are as deserving as any OBC or the third gender to whom the Supreme Court has recently extended this support.
  • The same or more financial, educational and empowerment support be given to ‘orphans’ as what is given by Government to various categories of children who have parents.
  • An official census or survey to have an official estimate of the extent of the ‘Children in Need of Care and Protection problem’ in India.
